Terms of Service

Welcome to Lunaire. These Terms of Service ("Terms") govern your use of the Lunaire iOS app and any related services (collectively, the "App"), operated by Akbarali Khasanov ("Lunaire", "we", "us", or "our").

Please read these Terms carefully. By installing or using the App you agree to be bound by them. If you don't agree, please don't use the App.

The App provides cycle-tracking and reproductive-health information for educational purposes only. It is not medical advice. See Section 6 for the full health disclaimer — it matters.

1. Eligibility

To use the App you must be at least 13 years old (or 16 if you live in the European Economic Area, the United Kingdom, or Switzerland, in line with GDPR Art. 8). If you are below the age of majority in your country, you may use the App only with the involvement and consent of a parent or legal guardian.

You also confirm that you are not barred from using the App under the laws of your country, and that you are not on any U.S. government list of prohibited or restricted persons.

2. Your account

Some features of the App require you to sign in with Apple Sign In. You are responsible for:

• Keeping your Apple ID secure (the App relies entirely on Apple's authentication).
• The accuracy of any information you provide (date of birth, cycle history, conditions, etc.).
• All activity that happens through your account.

If you suspect unauthorized access, sign out from Profile → Settings → Sign out and revoke the App's access at appleid.apple.com → Sign in with Apple.

We may suspend or terminate accounts that violate these Terms (Section 10).

3. License to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, solely for your personal, non-commercial use. This license is subject to the Apple Media Services Terms (https://www.apple.com/legal/internet-services/itunes/) in addition to these Terms.

You may not:

• Reverse engineer, decompile, or disassemble the App, except where this restriction is unenforceable under your local law.
• Use the App to harm anyone, including yourself.
• Use the App to violate any law or third-party right.
• Resell or sublicense the App.
• Use the AI Chat feature to generate content that depicts or promotes illegal activity, self-harm, or content involving minors.
• Scrape, mass-export, or otherwise extract data from our backend at a rate beyond what the App produces under normal use.

4. Subscription (Lunaire Premium)

The App is free to install. Some features are available only with a Lunaire Premium subscription.

4.1 Trial and billing

• A 7-day free trial is offered to new users who haven't previously subscribed. After the trial, the App automatically charges your Apple ID for the subscription you selected unless you cancel at least 24 hours before the trial ends.
• Prices and currencies are displayed in the App before you confirm a purchase.
• Subscriptions auto-renew at the end of each billing period unless you cancel.

4.2 Cancellation

• You can cancel at any time in Settings → Apple ID → Subscriptions on your iPhone, or by visiting https://support.apple.com/en-us/HT202039.
• Cancellation takes effect at the end of your current billing period. You keep premium features until then.
• We do not control Apple's billing. Refund requests should be directed to https://reportaproblem.apple.com.

4.3 Restoring purchases

If you reinstall the App or use a new device, tap Profile → Settings → Restore purchases to retrieve your active subscription.

4.4 Price changes

If we change the subscription price, Apple will notify you and ask for your consent before the new price applies. You may cancel at any time.

5. AI Chat

The in-app AI Chat is powered by Google's Gemini large language model. By using AI Chat you understand:

• Replies are generated by a language model. They may be incomplete, outdated, or wrong.
• Each message you send is transmitted to Google for inference. We don't store your messages on our backend; the local chat transcript is on your device only.
• AI Chat will refuse, redirect, or attach safety information when your message suggests a medical emergency or risk to your safety. This is not a substitute for calling emergency services.
• You must not enter personal information about other people in chat messages.

6. Not medical advice

This is the most important section. Please read it.

Lunaire is an information and self-tracking app. It is not a medical device. It does not diagnose, treat, cure, or prevent any disease. The content in the App — including phase guidance, daily insights, articles, and AI Chat replies — is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

Specifically:

• Cycle predictions are estimates. They are based on patterns in the data you log and a generic statistical model. They are not contraception. They are not a fertility treatment plan. Do not rely on them to avoid or to achieve pregnancy.
• Always consult a qualified clinician for any question about a medical condition, a medication, or a symptom that worries you.
• If you may have a medical emergency, call your local emergency number or go to the nearest emergency room. The App includes a region-aware emergency banner — but the banner cannot replace calling for help.
• Never disregard medical advice or delay seeking it because of something you read in the App.

By using the App you accept that we are not liable for any decision you make based on its content, to the maximum extent permitted by law (Section 9).

7. Your content

You retain all rights in the data you create in the App — your logs, your notes, your chat messages. We claim no ownership over your data.

You grant us a limited license to process your data exclusively to provide the App's features, as described in our Privacy Policy. You may revoke this license at any time by deleting your account.

If you submit feedback or suggestions, you agree we may use them to improve the App without owing you compensation. We won't identify you in any public discussion of the feedback.

8. Intellectual property

The App, its design, the Lunaire name and logo, the illustrations, the static phase content, and our codebase are protected by copyright and other intellectual-property laws. You may not copy, modify, or create derivative works from any of these without our written permission.

Third-party trademarks (Apple, Google Gemini, etc.) belong to their respective owners.

9. Disclaimers and limitation of liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement.

To the maximum extent permitted by law, in no event will Lunaire, its operator, or its service providers be liable for:

• Any indirect, incidental, consequential, special, or punitive damages.
• Any loss of profits, data, goodwill, or other intangible losses.
• Any decision you make in reliance on App content.

Our total liability for any claim arising out of or related to the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD 50.

Some jurisdictions don't allow exclusion of certain warranties or limitation of liability for incidental damages. In those jurisdictions, the limitations above apply only to the extent permitted.

Nothing in these Terms limits our liability for fraud, gross negligence, willful misconduct, or anything else that cannot be excluded under applicable law.

10. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms (for example: misusing AI Chat to harm someone, sharing your account, or attempting to break our backend). Where reasonable, we will give you notice and a chance to fix the breach.

You may delete your account at any time from Profile → Settings → Privacy → Delete account. After deletion, you lose access to your cycle history. Premium subscription billing is managed by Apple; you must cancel separately in iOS Settings (Section 4.2).

Sections 6, 7, 8, 9, 11, and 12 survive termination.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you inside the App at least 30 days before the change takes effect. By continuing to use the App after the change, you accept the new Terms. If you don't accept, please delete your account before the change takes effect.

The current version is always available at lunaire.emojinest.com/terms and inside the App under Profile → Settings → Terms of Service.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Uzbekistan, without regard to its conflict-of-laws rules. Mandatory consumer-protection rules in your country of residence still apply.

Any dispute that can't be resolved by friendly negotiation will be brought before the competent courts of Tashkent, Uzbekistan. If you are a consumer residing in the European Economic Area, you may instead bring proceedings in the courts of your habitual residence, as allowed by EU law.

The European Commission provides an online dispute-resolution platform at https://ec.europa.eu/consumers/odr.

13. Apple-specific terms

To the extent these Terms apply to App Store usage of the App:

• These Terms are between you and Lunaire, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any product-liability or intellectual-property claim related to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
